GRIT COURTS — TERMS OF SERVICE Grit Courts, a brand of Grit Concrete & Construction LLC ("Grit Courts," "we," "us")

1. Agreement These Terms of Service govern all work performed by Grit Courts for the customer ("Client," "you"). By signing a quote or proposal from Grit Courts, or by engaging Grit Courts to perform work, you agree to be bound by these Terms of Service, which are posted at builtwithgrit.com/terms-of-service. The signed quote itself does not need to restate these terms — using Grit Courts' services constitutes acceptance of them. 2. Scope of Work Work performed is limited to what is specifically outlined in the signed proposal, bid, or contract. Any additional work, design changes, or scope additions requested after signing will be documented in a written change order and may adjust the price and timeline. 3. Payment Structure Payment is due in three installments:

Deposit — due upon signing, to schedule the project and secure materials Progress Payment — due upon completion of concrete work and equipment installation, prior to continuing to surfacing and finish work Final Payment — due upon substantial completion of the project

Work will not proceed to the next phase until the corresponding payment has been received. Final payment is due before the project is considered complete and before any warranty coverage begins. Accepted payment methods: check, ACH, wire transfer, or credit card. Credit card payments carry a 3% processing fee. Late payments: Any payment not received within 14 days of its due date is considered past due and will accrue interest at 1.5% per month (18% annually) on the outstanding balance until paid in full. 4. Scheduling & Timelines Estimated start and completion dates are provided in good faith but are not guaranteed. Grit Courts is not liable for delays caused by weather, permitting, material availability, or other factors outside our reasonable control. We will communicate any expected delays as soon as they're known. 5. Site Access & Conditions Client is responsible for providing clear access to the work site, disclosing known underground utilities, irrigation lines, or obstructions, and ensuring the site is free of debris or obstacles that could delay work. Grit Courts is not responsible for damage to unmarked or undisclosed lines, sprinklers, or other buried utilities. 6. Permits & Compliance Unless otherwise stated in the proposal, Client is responsible for obtaining any required permits, HOA approvals, or zoning variances prior to the start of work. Grit Courts can assist with this process but is not responsible for delays or costs resulting from permitting or approval issues. 7. Change Orders Any changes to the scope of work, materials, or design after the contract is signed must be agreed to in writing by both parties before the change is made. Change orders may affect the final price and completion date. 8. Warranty All work is covered under the warranty terms described at https://www.builtwithgrit.com/courts-warranty. Please refer to that page for full coverage details, exclusions, and claim procedures. 9. Cancellation Deposits are fully refundable if Grit Courts has not yet ordered materials for the project. Once materials have been ordered, the deposit becomes non-refundable, as it covers material costs already incurred. 10. Limitation of Liability Grit Courts' liability for any claim arising from the work performed is limited to the amount paid by the Client for the project. Grit Courts is not liable for indirect, incidental, or consequential damages. 11. Governing Law These terms are governed by the laws of the State of Utah. 12.
